1. Acceptance of Terms; Eligibility
These Terms of Service ("Terms") are a binding agreement between you and DaoTiming™ ("we", "us", "the Service"). By accessing daotiming.com or any subdomain, purchasing any product, or using any feature, you accept these Terms, our Disclaimer, our Privacy Policy, and — for any automated or AI-driven access — our AI & Automated Access Policy, all of which are incorporated by reference. You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. If you do not agree, do not use the Service.
2. Scope of Services
The Service generates charts, written reports, interactive tools (including the Life Terminal), articles, and developer API access, computed from data you supply. All content is provided for entertainment, informational, and self-reflection purposes only, as described in the Disclaimer. We may change, add to, suspend, or discontinue any part of the Service at any time without prior notice.
3. Purchases, Delivery, and Refunds
Paid products are personalized digital goods: computation and generation begin at or immediately after payment, and delivery is electronic (on-screen access and/or email). By purchasing, you expressly request immediate performance and acknowledge that, once generation or delivery has begun, purchases are non-refundable except where a refund is required by applicable law or where we failed to deliver the product at all.
If you entered incorrect birth data, contact us promptly: for eligible products we offer a one-time data-correction re-run of the same order in place of a refund. Duplicate charges and failed deliveries will be corrected or refunded. Payments are processed by third-party processors (e.g. Stripe); we do not store your full payment credentials.
4. Your Data and Inputs
You represent that the information you submit (including birth data submitted about another person) is information you are lawfully entitled to provide. You grant us a license to process your inputs for the purpose of computing, delivering, improving, and supporting your orders. Handling of personal data is described in the Privacy Policy.
5. Intellectual Property; License to You
The Service and all of its content — software, algorithms, terminology systems (including our three-letter notation), chart designs, figures, articles, reports, brand names, and logos — are the intellectual property of DaoTiming and its founder and are protected by applicable law. Purchased reports are licensed to you for personal, non-commercial use. You may not resell, republish, mass-distribute, or offer as a service any content or output of the Service without our prior written permission. Quoting our published articles is welcome with attribution naming DaoTiming and a link, per the AI & Automated Access Policy.
6. Prohibited Conduct
You agree not to:
- scrape, bulk-download, mirror, or compile datasets from the Service, or access it with automated agents except as permitted by the AI & Automated Access Policy;
- reverse-engineer, decompile, or attempt to extract our algorithms, prompts, term tables, or models;
- circumvent payment, access controls, rate limits, or signed-URL protections;
- use the Service to harass, defame, or harm any person, or to make decisions about third parties (employment, lending, insurance, or similar) — the Service is not designed or offered for such use;
- misrepresent the Service's outputs as scientific fact or as our guarantee of any outcome;
- use the Service in violation of any applicable law.
We may suspend or terminate access for violations, without refund of amounts owed for misuse.
7. No Guarantees [Especially Important]
All readings, reports, predictions, windows, and track-record statements are probabilistic interpretations of a symbolic system. We guarantee no outcome, no accuracy level, and no fitness for any particular decision. You agree that you will not rely on the Service as the basis for medical, financial, legal, or other significant decisions, and that any such reliance is at your sole risk. This section works together with the Disclaimer, which is part of these Terms.
8. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions the exclusions apply to the maximum extent permitted.
9. Limitation of Liability
To the maximum extent permitted by law: (a) we shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill; and (b) our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or fifty U.S. dollars (US$50) if you have paid nothing. These limits apply regardless of legal theory and even if a remedy fails of its essential purpose.
10. Indemnification
You agree to indemnify and hold harmless DaoTiming, its owner, and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
11. Dispute Resolution; Arbitration; Class-Action Waiver
Before filing any claim, you agree to contact us at [email protected] and attempt informal resolution for thirty (30) days. Except for small-claims matters and injunctive relief for IP violations, any dispute arising out of these Terms or the Service shall be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, and you and we each waive the right to a jury trial and to participate in any class or representative action. You may opt out of this arbitration clause by emailing us within 30 days of first accepting these Terms.
12. Changes; Termination; Survival
We may amend these Terms by posting an updated version with a new date; continued use after posting constitutes acceptance. We may terminate or suspend access at any time for violation of these Terms. Sections concerning IP, disclaimers, liability limits, indemnification, and dispute resolution survive termination.
13. Governing Law; Severability; Entire Agreement
These Terms are governed by the laws of the United States and the state in which the Service's operator resides, without regard to conflict-of-law rules. If any provision is held unenforceable, the remainder stays in effect. These Terms, together with the documents incorporated by reference, are the entire agreement between you and us regarding the Service.
